Matters not provided for in these terms shall be handled in accordance with the rules of Article 39, laws and regulations, or general practice.

2. The Company may agree to special arrangements within a scope that does not conflict with the intent of these terms and rules, laws and regulations, administrative notices, or general practice. Where a special arrangement is made, that arrangement shall prevail over these terms.

Chapter 2 Reservation

Article 2 (Reservation request)

1. In renting a rental car, the renter may submit a reservation request in person, by telephone, over the internet, or through a travel agency or similar party contracted by the Company to handle contract work on its behalf, after agreeing to the contract and the separately defined rate table and in accordance with separately defined laws, by specifying in advance the vehicle class, rental start date and time, pickup location, rental period, return location, driver, whether options such as a child seat or navigation system are required, and other rental conditions (hereinafter the "rental conditions").

2. When a reservation request is received from the renter, the Company shall, as a rule, accept the reservation within the range of rental cars it holds, except where an agency rental is carried out under Article 35, Paragraph 1 (including cases where a vehicle received for agency rental under that paragraph is rented out as a substitute vehicle).

In this case, the renter shall pay the separately defined reservation deposit, except where the Company specifically provides otherwise.

3. For internet reservations, if the reservation confirmation email from the Company cannot be delivered to the email address entered by the customer, the Company shall treat the reservation as not concluded.

Article 3 (Change of reservation)

A renter who wishes to change the rental conditions under Paragraph 1 of the preceding article must obtain the Company's prior consent. However, where the reservation was requested through a travel agency or similar party contracted by the Company to handle reservation work on its behalf, the reservation may be changed only if the change is requested at the business location of the reservation agent that received the original request.

Article 4 (Cancellation of reservation, etc.)

The renter may cancel a reservation in accordance with separately defined rules.

2. If, for reasons attributable to the renter, the renter has not begun the procedure for concluding the rental car agreement (hereinafter the "rental agreement") more than one hour after the reserved rental start time, the reservation shall be treated as cancelled.

3. In the cases of the preceding two paragraphs, the renter shall pay the Company a reservation cancellation fee in accordance with separately defined rules, and where the Company has received a reservation deposit it shall offset that deposit against the cancellation fee.

4. Where a reservation is cancelled for reasons attributable to the Company, or where a rental agreement is not concluded, the Company shall refund the reservation deposit it has received.

5. Where a rental agreement is not concluded due to an accident, theft, non-return, recall, natural disaster, or any other cause not attributable to either the renter or the Company, the reservation shall be deemed cancelled, and the Company shall refund the reservation deposit it has received.

Article 5 (Substitute rental car)

Where the Company is unable to prepare a rental car of the vehicle class reserved by the renter, it may rent out a rental car of a class different from the reservation (hereinafter the "substitute rental car").

2. Where the renter accepts the offer in the preceding paragraph, the substitute rental car shall be rented out under the same rental conditions as at the time of reservation, except for the vehicle class. If the rate of the substitute rental car is higher than that of the reserved vehicle class, the rate of the reserved vehicle class shall apply; if it is lower, the rental rate of the vehicle class of that substitute rental car shall apply.

3. The renter may refuse the substitute rental car under Paragraph 1 and may also cancel the reservation.

4. In the case of the preceding paragraph, where the reason the rental under Paragraph 1 cannot be made is attributable to the Company, it shall be treated as a cancellation under Article 4, Paragraph 4, and the Company shall refund the reservation deposit.

5. In the case of Paragraph 3, where the reason the rental under Paragraph 1 cannot be made is attributable to the Company, it shall be treated as a cancellation under Article 4, Paragraph 5, and the Company shall refund the reservation deposit.

For this purpose, upon conclusion of the rental agreement the Company may require the renter to present the driver's licence of the driver designated by the renter (hereinafter the "driver") or to provide a copy of it. In this case, if the renter is the driver, the renter shall present his or her own driver's licence or provide a copy of it; if the driver is a different person, the renter shall present that driver's licence or provide a copy of it.

(Note 1) The basic notice of the supervisory authority means items 2 (10) and (11) of the notice of the Director-General of the Road Transport Bureau of the Ministry of Land, Infrastructure, Transport and Tourism (Basic Notice on Rental Cars) (Ji-Ryo No. 138, 13 June 1995).

Article 10 (Formation of the rental agreement, etc.)
